A Landmark Court of Appeal Victory
In 2019, we represented Nicky Herbert in Herbert v HH Law Ltd [2019] EWCA Civ 527, one of the leading cases concerning success fees deducted from personal injury compensation.
The Court of Appeal confirmed that a solicitor cannot establish that a client gave informed approval to a success fee merely by pointing to the documents they signed. The solicitor must have provided a full and fair explanation of the charge so that the client could make a properly informed decision.
That landmark judgment provided important guidance for clients who were charged a standard or blanket success fee without a proper explanation of how it had been calculated.
